Entered the Confederate Army at age 22 as a Sergeant in Co. D, 12th Regiment of the NC Infantry, promoted to First Sergeant until unit disbanded 16 Dec 1861. Joined Co A., 46th NC Infantry (Lumberton Guards) and was made Captain and transferred to Co. B of the 46th. Wounded at the battle of the Wilderness and was paroled at Greensboro May 1, 1865.

Promote to Colonel in the NC militia, he gathered a band of men to bring the Lowery gang to justice. He was ambushed by the gang and was found murdered in 1882.

Written the the family bible by his widow on the day of his death; "DEATHS. May 2, 1872, Francis Marion Wishart, killed by the Lowrys. Oh, God, to whom all vengeance belongs, avenge his death, and speedily."

His brothers formed a new militia group called "The Wishart Company" to search out the Lowerys and bring peace to the County.
